1. Who we are and what these Terms cover
dammfidyahmakkah is a brand operated by Neuvano Company (شركة نيوفانو), a single-person limited liability company registered in the Kingdom of Saudi Arabia under Commercial Registration No. 7053942988 (“we”, “us”, “the Operator”), operating from the Makkah sheep market with licensed sheep sales in Makkah (License 26/02/472181/755).
These Terms and Conditions (“Terms”) govern your access to and use of dammfidyahmakkah.com (the “Website”) and every order you place through the Website or through our official WhatsApp, phone or email channels (each an “Order”).
By using the Website or placing an Order you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or place an Order.
These Terms are issued in English and Arabic. In the event of any inconsistency, the Arabic version prevails.
2. Nature of our service
We provide a coordination and fulfilment service. When you place an Order, you appoint us as your agent to purchase, on your behalf and in your name (or in the name of the person you designate), an animal meeting the criteria you select, arrange its slaughter in or around Makkah in accordance with Islamic requirements, and distribute the meat in accordance with Section 7.
We are not a religious authority, a scholar, a mufti, a charity, or a government body. We do not issue religious rulings (fatwa), and we do not determine whether a Damm, Fidyah, Hady or Sadaqah is obligatory for you, which type applies to your situation, or whether your obligation has been discharged. You are responsible for consulting a qualified scholar or your Hajj/Umrah group leader regarding your own obligation, intention (niyyah), timing and type of sacrifice.
We undertake to perform the service with due care and in good faith, and to provide proof of performance as described in Section 6. We cannot and do not guarantee acceptance of any act of worship, which rests with Allah alone.
Our services are offered subject to the licences, permits and approvals required under Saudi law. Certain services (including Hady during Hajj) may be subject to seasonal rules, capacity limits or authority requirements which may restrict what we can accept at a given time.
3. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a binding contract to place an Order. If you order on behalf of another person or a group, you confirm that you are authorised to do so and to share their details with us.
You are responsible for the accuracy of all information you provide, including the name(s) of the person(s) on whose behalf the sacrifice is to be performed, the type of sacrifice, the number of animals, and your contact details. We are not responsible for errors caused by inaccurate or incomplete information.
If the Website offers accounts, you are responsible for keeping your login details confidential and for all activity under your account.
4. Orders, prices and confirmation
Product and service descriptions, prices and availability shown on the Website are an invitation to order, not a binding offer. An Order is accepted only when we send you an Order confirmation (by email, WhatsApp or SMS) with an Order number.
Prices are stated in Saudi Riyals (SAR). Prices include or exclude Value Added Tax as indicated at checkout. Payment-gateway fees, bank charges, currency conversion fees and international transfer fees charged by your bank or payment provider are your responsibility unless stated otherwise.
Animal prices vary with market conditions, season and demand, particularly around Hajj and Eid al-Adha. The price shown at the time of Order confirmation is the price that applies to your Order. We reserve the right to correct obvious pricing errors and to offer you the choice of proceeding at the correct price or cancelling with a full refund of any amount paid.
We may decline or limit any Order at our discretion, including where capacity is exhausted, where the requested timing cannot be met, where authority rules restrict the service, or where we suspect fraud or misuse. Any amount paid for a declined Order will be refunded in full.
Bulk and group Orders (including Orders from Hajj/Umrah agents, group coordinators and charitable buyers) may be subject to a written quotation, a deposit, a minimum quantity, a cut-off date and specific delivery-of-proof arrangements, which will be confirmed in writing before acceptance and form part of these Terms.
5. Payment
Payment may be made through the payment methods shown at checkout (which may include card payment through a licensed payment gateway, bank transfer, or other methods we approve). We do not store your full card details; card payments are processed by the payment provider.
Two payment routes are offered. If you prepay at checkout, payment is due in full at the time of Order. If we have agreed the pay-after-proof route, payment is due promptly after Proof is delivered to you. The same Proof is provided on both routes.
On the prepaid route, an Order is not scheduled for fulfilment until the required payment (or deposit) has been received and cleared.
Where you pay from outside Saudi Arabia, you are responsible for ensuring the transfer is lawful in your jurisdiction and for any fees deducted by intermediary banks. The amount we must receive is the SAR amount stated in the Order confirmation.
6. Fulfilment, timing and proof of performance
We will use reasonable efforts to perform the sacrifice on the date, or within the window, stated in your Order confirmation. Hady Orders are performed only during the days permitted by Islamic rules for Hady (the days of Nahr/Tashreeq), and Damm/Fidyah Orders are performed on the schedule agreed with you. Dates are in Saudi Arabia local time and follow the Umm al-Qura calendar as announced by the competent Saudi authorities.
Timing may be affected by slaughterhouse schedules, authority instructions, market supply, weather, transport restrictions in Makkah during Hajj, and other circumstances outside our reasonable control. If we cannot perform within the agreed window, we will inform you promptly and offer a new date or a refund in accordance with Section 8.
Proof of performance. For each Order we will provide photographs and/or short video of the animal and the slaughter, showing the Order number and/or the name(s) you designated, together with a written confirmation of the date and location (“Proof”). Proof is delivered to the contact channel you provide (normally WhatsApp or email), normally within 24 hours of performance; during peak seasons it may take longer, and we will keep you informed.
Proof is provided as evidence of performance. Visual identification of an individual animal in a group slaughter may be limited by practical conditions; where Proof cannot be individually produced for a bulk or group Order, we will provide consolidated Proof covering the whole Order and confirm the number of animals performed. Proof may show slaughter scenes; please consider this before sharing it with others.
Video calls, live streaming or your physical attendance at the sacrifice may be offered where practical and, if offered, are subject to availability, location access rules and additional charges notified in advance. They are not a standard part of the service unless stated in your Order confirmation.
We may photograph or film the performance for the purpose of producing Proof and for our internal records. See the Privacy Policy for how these images are handled.
7. Meat distribution and delivery
Unless your Order confirmation states otherwise, the meat of every Damm, Fidyah, Hady and Sadaqah sacrifice is distributed to the poor and needy within the boundaries of the Haram of Makkah in accordance with Islamic requirements. Because the meat is given to beneficiaries, it is not delivered to you and cannot be returned, exchanged or inspected after performance.
Where you purchase a live animal or meat for your own use (for example, a sheep purchased for personal consumption or an Aqeeqah where you request a share of the meat), delivery location, timing, handling and any applicable food-safety requirements will be agreed in writing and may carry additional charges. Risk in the animal or meat passes to you on delivery or collection.
We do not ship live animals or meat outside Saudi Arabia.
8. Changes, cancellation and refunds
Because we purchase animals and schedule slaughter in reliance on confirmed Orders, cancellation rights depend on the stage of fulfilment:
- Before the animal is purchased for your Order: you may cancel for a full refund of amounts paid, less any non-refundable payment-gateway or bank charges disclosed at checkout.
- After the animal has been purchased but before slaughter: cancellation may be accepted at our discretion. If accepted, we may deduct our direct costs (including any loss on resale of the animal, holding and transport costs) and we will refund the balance.
- After slaughter has been performed: the service has been completed and no cancellation or refund is possible, except where we failed to perform as described below.
Cut-off. For Hady and other Hajj-season Orders, changes or cancellations cannot be accepted after the cut-off stated in your Order confirmation, because animals are purchased in advance for the season.
Our failure to perform. If we are unable to perform your Order in the agreed window and you do not accept a rescheduled date, or if we perform the service materially differently from your Order (for example, the wrong type or number of animals) and cannot correct it, you are entitled to a full refund of the amount paid for the affected part of the Order. This is your sole remedy for non-performance, subject to Section 10.
Changes to names, type of sacrifice or quantity may be requested before the animal is purchased and are subject to our written confirmation. Changes may affect price and timing.
Refunds are made to the original payment method where possible, within 3 business days of our written confirmation of the refund. We are not responsible for delays by banks or payment providers, or for exchange-rate differences on international payments.
Non-payment on pay-after Orders. Where we have agreed in writing to perform before full payment, you remain liable for the full Order price once the service is performed and Proof is delivered. We may recover unpaid amounts through lawful means and may decline future Orders from you or your group.
Nothing in this Section limits any rights you have under Saudi consumer-protection regulations that cannot be excluded by agreement.
9. Your responsibilities
When using the Website or placing an Order, you agree to:
- Provide accurate names, quantities, type of sacrifice, dates and contact details, and respond promptly to our requests for clarification.
- Confirm your own religious obligation and preferred timing with a qualified scholar or your group leader.
- Ensure you are authorised to order for other persons and to share their personal data with us.
- Not use the Website for any unlawful purpose, not attempt to interfere with its operation, and not copy, scrape or reproduce its content without permission.
- Not misrepresent the service to third parties, including describing it as an official government or charity programme.
10. Liability
We will perform the service with reasonable care and skill. Subject to the paragraph on non-excludable liability below, our total liability to you for any claim arising out of or in connection with an Order, whether in contract, tort or otherwise, is limited to the total amount you paid for that Order.
Subject to the same paragraph, we are not liable for indirect or consequential loss, loss of opportunity, travel or accommodation costs, or for any loss arising from inaccurate information you provided, from your own religious determinations, or from events outside our reasonable control (including authority instructions, closures, market shortages, disease outbreaks affecting livestock, transport restrictions, network or payment-system failures, or force majeure).
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, or any liability that cannot be excluded under the laws of the Kingdom of Saudi Arabia.
The Website and its content are provided on an “as is” basis. We do not guarantee that the Website will be uninterrupted or error-free, or that information on it (including prices and availability) is always current.
11. Intellectual property
The dammfidyahmakkah name, logo, Website design, text, photographs and videos are owned by or licensed to the Operator and are protected by Saudi and international intellectual-property laws. You may not use them without our prior written consent, other than viewing the Website and sharing Proof relating to your own Order for personal, non-commercial purposes.
If you submit a review, testimonial or photograph to us, you grant us a non-exclusive, royalty-free licence to use it in connection with our services, and you confirm you have the right to grant that licence. You may withdraw consent for future use by contacting us.
12. Third-party services
The Website may use third-party services (payment gateways, messaging platforms, mapping, analytics and hosting). Those services are governed by their own terms and privacy policies. We are not responsible for the content or practices of third-party websites linked from the Website.
13. Communications and notices
By placing an Order you agree to receive transactional communications (Order confirmation, scheduling, Proof and payment messages) by email, SMS, WhatsApp or telephone. Marketing communications are sent only with your consent and you may opt out at any time.
Our official channels are listed in Section 16. We are not responsible for messages sent to, or received from, unofficial numbers or accounts claiming to represent us.
14. Changes to the Website and these Terms
We may update these Terms from time to time. The version in force at the time of your Order confirmation applies to that Order. The current version and its effective date are always published on the Website.
We may change, suspend or withdraw any service or the Website at any time, including for seasonal or regulatory reasons, without affecting Orders already confirmed.
15. Governing law, complaints and disputes
These Terms and every Order are governed by the laws and regulations of the Kingdom of Saudi Arabia.
If you have a complaint, please contact us first using the details in Section 16. We aim to acknowledge complaints within 7 business days and to resolve them within 1 business day of acknowledgement. Unresolved complaints may be referred to the competent authority (including the Ministry of Commerce consumer-protection channels) or to the competent courts of the Kingdom of Saudi Arabia, which have exclusive jurisdiction.
If any provision of these Terms is held invalid, the remaining provisions remain in force. Our failure to enforce any provision is not a waiver of it.
You may not transfer your rights under an Order without our written consent. We may transfer our rights and obligations to a successor operator of the brand, provided this does not reduce your rights under these Terms.
